Privacy Policy

Last Updated: October 1, 2026

This Privacy Policy describes how Outmarket AI Inc. ( “we”, “us”, or “our”) handles personal information that we collect through our websites on which a link to this Privacy Policy is displayed, through our marketing initiatives, when you apply for a job with us, and in connection with other interactions with you (collectively, the “Service” or “Services”). By accessing or using our Services, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use our Services.

This Privacy Policy does not apply to our handling of personal information that we process on behalf of our business customers. Our processing of that personal information is governed by the agreements we have with our business customers. This Privacy Policy also does not apply to third-party websites, products, or services that may be linked from our Services.

Personal information we collect

Information you provide to us:

  • Contact information, such as your first and last name and email address, phone number, company or organization name, and job title.

  • Feedback or correspondence, such as information you provide when you contact us with questions or feedback, or otherwise correspond with us online.

  • Registration and engagement information, such as information you provide when you request a demo, register for an event or webinar, subscribe to our newsletter, or complete a form on our website.

  • Chat communications, such as the messages, attachments, and other content you submit through chat widgets on our website, and records or transcripts of those conversations.

  • Other information that we may collect which is not specifically listed here, but which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information you provide to us about others: Where you provide us with the personal information of third parties, such as your business contacts, it is your responsibility to (1) inform them about our processing of their personal information in accordance with this Privacy Policy and (2) confirm that they have given you their permission.

Information we obtain from third parties:

  • Social media information. We may maintain pages on social media platforms, such as LinkedIn, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use, and processing of your personal information. You or the platforms may provide us with personal information about you through the platform, and we will treat such information in accordance with this Privacy Policy.

  • Other sources. We may obtain personal information from other third parties, such as marketing partners, publicly-available sources, and data providers.

  • Company identification and enrichment data. We and our service providers may match your IP address and other online identifiers to publicly available and commercially licensed databases (often called “reverse IP” or visitor identification) to infer the company or organization associated with your visit, and may append information such as company name, industry, size, and general location. We may associate this information with other information we hold about you or your organization.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interactions over time with our website, our communications and other online services, such as:

  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state or geographic area (including as inferred from your IP address).

  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Services, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.

  • Session and interaction data, such as mouse movements, clicks, taps, scrolling, hovering, text selection, window resizing, errors and other technical events, and the content displayed on your screen as you interact with our website, which may be recorded and replayed or aggregated into heatmaps.

  • Form and keystroke data, such as the form fields you interact with, the information you type into those fields (including information you type but do not submit), the time spent in each field, and whether you complete or abandon a form.

  • Email open/click information. We may use pixels in our email campaigns that allow us to collect your email and IP address as well as the date and time you open an email or click on any links in the email that we may send to you.

We use the following tools for automatic data collection:

  • Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand website user activity and patterns. For example, Google Analytics collects information about how users use our website, which we then use to compile reports that disclose trends without identifying individual visitors, and help us improve our website. For more information on Google Analytics, see Google’s explanation at policies.google.com/technologies/partner-sites. We use strictly necessary cookies, as well as cookies for performance and analytics, functionality, and (where permitted) advertising.

  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

  • Session replay and heatmap technologies, which are scripts, provided by us or our service providers, that record or reconstruct your interactions with our website (including mouse movements, clicks, scrolling, and the page content displayed) and use that information to produce session recordings, replays, and heatmaps.

  • Form-interaction and keystroke capture technologies, which log how you interact with form fields and the text you enter into them, as described below.

  • Chat widgets, which are embedded chat tools, operated by us or a service provider, that let you communicate with us (or with automated or AI-assisted assistants on our behalf) and that record the content and metadata of those conversations.

  • Reverse IP lookup and visitor identification tools, which match your IP address and other identifiers against third-party databases to identify the organization associated with your visit.

Session replay, heatmaps, form capture, chat, and visitor identification

What we capture. Where these tools are enabled, we and our service providers may record and analyze your interactions with our website, including pages viewed, mouse movements, clicks, taps, scrolling, form-field activity, and text you type into forms, search boxes, and chat windows. Recordings may reflect the content that appears on your screen during your visit.

Why we use them. We use these tools to understand how visitors use our website, troubleshoot errors and usability problems, improve our website, content, and Services, secure our website and detect fraud and abuse, respond to your chat inquiries and form submissions, and identify and prioritize organizations that may be interested in our Services for our sales and marketing purposes. We may use information you type into a form or chat window, including information you enter but do not submit, to follow up with you.

Sensitive information. We configure these tools to mask or exclude fields that we know to be sensitive, such as passwords and payment card numbers, and we do not intentionally use them to collect sensitive personal information. Please do not enter sensitive information (such as government identification numbers, financial account numbers, or health information) into free-text fields or chat windows on our website.

Service providers. These tools are generally operated by service providers that process the information on our behalf under written agreements that restrict their use of it to providing services to us. Those providers may store recordings and related data on their systems.

Consent and choices. Where required by law, we use these tools only after you have consented through our cookie banner or Cookie Settings. Where consent is not required, we provide notice through this Privacy Policy and our cookie banner. You may withdraw or change your choices at any time through Cookie Settings, which is available in the footer of our website, or as described in “Your privacy rights and choices” below. Chat conversations may be reviewed by our personnel and service providers, and conversations with automated assistants are processed using automated technology.

How we use your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

To provide and operate our Services and communicate with you. We use personal information to provide and operate our Services, respond to your requests and inquiries, provide customer support, and otherwise communicate with you about our Services, including by sending announcements, surveys, updates, security alerts, and support and administrative messages.

To improve, monitor, and personalize our Services. We use personal information to improve our Services, including by understanding your needs and interests, and personalizing your experience with the Services and our communications. This includes analyzing session recordings, heatmaps, and form-interaction data to identify usability issues and improve our website.

To identify and engage prospective customers. We use personal information, including information obtained through chat, forms, and reverse IP or visitor identification tools, to identify organizations that may be interested in our Services, to route and respond to inquiries, and to tailor our sales and marketing communications.

For research and development. We may use your personal information for research and development purposes, including to analyze and improve our Services and our business. As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We may use this data and disclose it to third parties for our lawful business purposes, including to analyze and improve our Services and promote our business.

Direct marketing. We may from time-to-time send you direct marketing communications as permitted by law, including, but not limited to, newsletters, and updates on news and events. You may opt out of our marketing emails as described in the “Opt out of marketing communications” section below.

For interest-based advertising. We may engage advertising partners, including third party advertising companies and social media companies, to display ads around the web. These companies may use cookies and similar technologies to collect information (including the automatically-collected data described above) about your interactions over time across our website, our communications, and other online services, and use that information to serve online ads that they think will interest you. Where required by law, we use advertising cookies and similar technologies only with your consent, and you may opt out as described under “Your privacy rights and choices” below.

With your consent. We may use or disclose personal information for specific purposes to which you have consented at the time of collection or at other times, and you may withdraw your consent at any time.

For compliance and protection. We may use your personal information to:

  • Comply with applicable laws, lawsuits, and legal processes, such as responding to subpoenas or requests from government authorities.

  • Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims).

  • Audit our internal processes for compliance with legal and contractual requirements and internal policies.

  • Enforce the terms and conditions that govern our website.

  • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

How we disclose your personal information

Service providers. We may disclose your personal information to third party companies and individuals that provide services on our behalf or help us operate our Services (such as lawyers, bankers, auditors, insurers, customer support, hosting, analytics, session replay, chat, visitor identification, email delivery, marketing, and database management).

Affiliates. We may disclose your personal information to our corporate parent, subsidiaries, and affiliates, which may use it consistent with this Privacy Policy.

Authorities and others. We may disclose your personal information to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Advertising partners. Third party advertising companies, including for the interest-based advertising purposes described above.

Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction), such as a corporate divestiture, merger, consolidation, acquisition, reorganization, sale of assets, or in the event of bankruptcy or dissolution. In such cases, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

With your consent. We may disclose personal information with your consent or at your direction.

Limited Use of Google User Data

Outmarket AI’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements. The use and transfer of raw or derived user data received from Google Workspace APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Outmarket AI does not transfer Google user data to, or use it with, any third-party AI/ML service, and does not use Google Workspace data to develop, improve, or train generalized or non-personalized AI/ML models.

Your privacy rights and choices

Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions contained in the marketing communication we send you. You may continue to receive service-related and other non-marketing emails.

Personal information requests. Depending on your location and the nature of your interactions with our Services, you may request the following in relation to the personal information we hold about you:

  • Information about how we have collected and used your personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.

  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide this information in a portable, machine-readable, readily usable format.

  • Correction of personal information that is inaccurate or out of date.

  • Deletion of the personal information that we have collected about you, subject to certain exceptions provided by law.

  • Objection or restriction, including objecting to or requesting that we restrict certain processing of your personal information, and withdrawing consent where we process your personal information based on consent.

  • Opt-out of the sale of your information or sharing of your information for interest-based advertising. We do not sell personal information in exchange for monetary consideration. However, our use of certain advertising and analytics cookies and similar technologies, and the disclosure of identifiers and online activity data to advertising and analytics partners in connection with them, may be considered a “sale” or “sharing” under certain U.S. state privacy laws. You may opt out at any time through Cookie Settings, our “Do Not Sell or Share My Personal Information” link, or an opt-out preference signal such as Global Privacy Control. We do not have actual knowledge that we have sold or shared the personal information of children under the age of 16.

To make a request, please contact us. You may submit a request by emailing support@outmarket.ai or using the contact details in “How to contact us” below. Prior to responding to your requests, we may verify your identity by matching any requested identifying information you provide against the information we have about you. Depending on your jurisdiction, you may designate an authorized agent to make a request on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination. We will respond to requests within the time required by applicable law (generally 45 days, which may be extended where permitted). If we deny your request, you may appeal by replying to our response or contacting us, and we will respond to your appeal as required by applicable law.

Limits on your choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, please contact us.

Limit online tracking. There are a number of ways to limit online tracking, which we have summarized below. Please note that these tools are not associated with us and we cannot guarantee that they work as their providers advertise them:

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. You may also be able to prevent our websites from setting cookies by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers. You can also opt out of Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout. Blocking cookies or scripts may prevent session replay, chat, and similar tools from functioning and may affect the functionality of our website.

  • Advertising industry opt out tools. You can also use these opt out options to limit use of your information for interest-based advertising by participating companies:

  • Platform Opt-Outs. You can also use the opt-out features offered by third-party advertising platforms, such as:

  • Cookie Settings and opt-out preference signals. You can manage non-essential cookies and similar technologies, including session replay, through the “Cookie Settings” link in the footer of our website. Where required by applicable law, we treat recognized opt-out preference signals, such as Global Privacy Control, as a valid request to opt out of sales and sharing for the browser or device that sends the signal.

  • Chat, forms, and visitor identification. You can avoid chat and form capture by not using those features. To opt out of reverse IP or visitor identification, or to ask us to delete a recording or chat transcript associated with you, contact us as described below.

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals, as there is no common standard for them. However, as described above, we honor Global Privacy Control and other legally recognized opt-out preference signals where required by law. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Other sites, mobile applications and services. Our Services may contain links to other websites, mobile applications, and other online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and disclosure of your personal information. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

Security

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information. If required by applicable law, we will notify you and the relevant authorities of a security breach affecting your personal information.

Retention of personal information

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws and regulatory obligations.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.

Recordings and session data captured through session replay, heatmap, and similar tools are generally retained for 12 months, and chat transcripts and form submissions are retained for as long as needed to respond to your inquiry and maintain our business relationship, unless a longer period is required or permitted by law.

Additional information for U.S. state residents

This section supplements this Privacy Policy for residents of California and other U.S. states with comprehensive privacy laws. Over the past 12 months, we have collected the following categories of personal information, as those categories are defined by applicable law, from the sources and for the purposes described above:

  • Identifiers, such as name, email address, phone number, IP address, and online identifiers (disclosed to service providers and, in the case of online identifiers, advertising and analytics partners).

  • Internet or other electronic network activity, such as browsing activity, session and interaction data, and form-interaction data (disclosed to service providers and advertising and analytics partners).

  • Professional or employment-related information, such as company, job title, and, for job applicants, employment history (disclosed to service providers).

  • Audio, electronic, or similar information, such as chat transcripts and session recordings (disclosed to service providers).

  • Geolocation data, limited to approximate location inferred from your IP address (disclosed to service providers and advertising and analytics partners).

  • Inferences, such as inferences about the organization associated with your visit and its interest in our Services (disclosed to service providers).

We do not knowingly collect sensitive personal information, as defined by applicable law, for the purpose of inferring characteristics about you. We retain each category of personal information for the periods described in “Retention of personal information” above.

Additional information for individuals in the European Economic Area, the United Kingdom, and Switzerland

If you are located in the EEA, the UK, or Switzerland, Outmarket AI Inc. is the controller of the personal information described in this Privacy Policy. We process your personal information on the following legal bases: (1) our legitimate interests, such as operating, securing, and improving our website and Services and promoting our business, which are not overridden by your interests and rights; (2) your consent, such as for non-essential cookies, session replay, and similar technologies, which you may withdraw at any time without affecting the lawfulness of prior processing; (3) performance of a contract, or steps taken at your request before entering into one; and (4) compliance with legal obligations.

In addition to the rights described above, you may object to processing based on our legitimate interests, request restriction of processing, request data portability, and lodge a complaint with your local data protection authority.

International data transfers

We are based in the United States, and our service providers may be located in the United States and other countries. If we transfer personal information from the EEA, the UK, or Switzerland to a country that has not been recognized as providing an adequate level of protection, we rely on appropriate safeguards, such as standard contractual clauses or other lawful transfer mechanisms.

Job applicants

If you apply for a job with us, we may collect personal information about you, such as your contact information, employment and education history, professional qualifications, and other information that may be included in a resume or that you may provide during the interview process. This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We also collect personal information from other sources where relevant for your application, such as employment research firms, recruiters, identity verification services, and information that you make publicly available on websites or social media platforms (for example, LinkedIn).

Throughout the recruitment process, we may supplement your personal information in connection with the assessment of your application. For example, we may record the views of those considering your application about your suitability for the role for which you have applied and retain interview notes. If you accept an offer from us, your personal information will be incorporated into and used as part of your employee record.

We use applicants’ information to facilitate our recruitment activities, process employment applications and personalize candidate communication, including evaluating candidates and monitoring recruitment statistics. We also use successful applicants’ information to administer the employment relationship. We may also use and disclose applicants’ information to improve our Services and for the compliance and protection purposes described above. We retain applicant information for as long as needed to evaluate your application and as required by applicable law, and you may request access to or deletion of your information as described in “Your privacy rights and choices” above.

Children

Our website is not intended for use by children under 18 years of age. If we learn that we have collected personal information through the website from a child under 18 without the consent of the child’s parent or guardian as required by law, we will take steps to delete it. If you believe a child has provided us with personal information, please contact us.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the website. Where required by law, we will provide additional notice (such as by email or a prominent notice on our website) or obtain your consent. Where permitted by law, your continued use of our Services after the updated Privacy Policy is posted constitutes your acceptance of the changes.
